1. Introduction and Acceptance
1.1 Agreement to Terms
These Terms of Service (Terms) constitute a legally binding agreement between you and Her Journey Pty Ltd (ABN 50 696 504 891) (Her Journey, we, us, our). These Terms govern your access to and use of the Her Journey website at herjourney.com.au, mobile applications (iOS and Android), and all related services (collectively, the Platform).
By creating an account, making a purchase, or otherwise accessing our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.
1.2 Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by posting a notice on our Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your subscription or close your account before the changes take effect.
1.3 Additional Policies
These Terms incorporate by reference our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our Platform, you also agree to our Privacy Policy.
2. Eligibility
2.1 Age Requirements
You must be at least 18 years of age to create an account and use our Platform. By using our Platform, you represent and warrant that you meet this age requirement.
2.2 Geographic Availability
Our Platform is designed for users located in Australia. While users from other countries may access our Platform, our content is created specifically for the Australian healthcare context and may not be appropriate or accurate for users in other jurisdictions.
2.3 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorised use of your account.
3. Our Services
3.1 Platform Description
Her Journey is a digital health education platform that provides evidence-based women’s and maternal health information for Australian women throughout their fertility, pregnancy, and postpartum journey. Our Platform includes:
- Educational courses and video content
- Articles and guides on women’s and maternal health topics
- Personalised pregnancy and postpartum journey tracking
- Practitioner directory
- Checklists and planning tools
3.2 Educational Content Only
IMPORTANT: Our Platform provides educational information only and does not constitute medical advice, diagnosis, or treatment. The content on our Platform is designed to supplement, not replace, the relationship between you and your healthcare providers.
You should always consult with qualified healthcare professionals for medical advice specific to your circumstances. Never disregard professional medical advice or delay seeking it because of information you have read on our Platform.
If you are experiencing a medical emergency, call 000 (Triple Zero) immediately.
3.3 Evidence-Based Methodology
Her Journey follows the evidence - not any single organisation or guideline. Our content is developed through systematic review of current clinical research from Australian and international sources, including:
- Australian clinical bodies (Safer Care Victoria, Clinical Excellence Queensland, NSW Agency for Clinical Innovation)
- National bodies (NHMRC, Australian Commission on Safety and Quality in Health Care)
- Professional colleges (RANZCOG, Australian College of Midwives)
- International evidence (Cochrane Collaboration, WHO recommendations)
- Peer-reviewed journals
While we make reasonable efforts to ensure our content is accurate and current, medical knowledge evolves, and we cannot guarantee that all content will be completely accurate or up-to-date at all times.
3.4 Clinician Content Disclaimer
Content created by our clinician contributors represents their professional opinions based on available evidence at the time of creation. Her Journey conducts clinical review of all contributor content but does not guarantee the accuracy of individual contributions. Clinician contributors are independent professionals and their views may not represent the views of Her Journey. You should always verify information with your own healthcare providers.
3.5 No Product Endorsements or Therapeutic Goods Advertising
Our content is general education. We do not advertise, endorse, or recommend any specific therapeutic goods (such as medicines, supplements, or medical devices), and we do not make therapeutic claims about them. Our clinician contributors do not endorse therapeutic goods through the Platform. Any product mentioned is for general information only and is not an endorsement or a recommendation to purchase.
4. Account Registration
4.1 Creating an Account
To access certain features of our Platform, including purchasing courses or subscriptions, you must create an account. When creating an account, you agree to provide accurate, current, and complete information.
4.2 Account Security
You are responsible for:
- Keeping your password confidential
- Restricting access to your account
- All activities that occur under your account
- Notifying us immediately of any unauthorised access
4.3 One Account Per Person
Each account is for a single user only. You may not share your account credentials with others or allow others to access your account. If we detect multiple accounts held by the same person, we reserve the right to merge or close accounts and adjust subscription benefits accordingly.
5. Pricing and Payment
5.1 Pricing
All prices displayed on our Platform are in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable. We reserve the right to change our prices at any time, but price changes will not affect purchases or subscriptions already in effect at the time of the change.
5.2 Payment Methods
We accept payment via credit card (Visa, Mastercard, American Express) and other payment methods as displayed at checkout. All payments are processed securely through our payment provider, Stripe, or through the Apple App Store or Google Play Store for in-app purchases. We do not store your full payment card details on our systems.
5.3 Payment Processing and Failed Payments
When you make a purchase, you authorise us to charge the payment method you provide. If your payment cannot be processed for any reason, we will attempt to process payment up to 3 times over 7 days. We will notify you by email of each failed attempt. If payment is not successfully processed within 14 days of the original due date, your access to paid content will be suspended. Your account data and progress will be retained for 90 days, during which time you can update your payment method and restore access. After 90 days, we may delete your progress data.
5.4 Receipts and Invoices
You will receive an email receipt for each purchase. You can also access your purchase history and download invoices through your account settings. Tax invoices for GST-registered users will be provided upon request.
6. Subscriptions
6.1 Subscription Plans
We offer the following subscription options:
- Her Journey Package: $16 per month, or $144.99 per year (save $47)
- Premium+: $22 per month, or $199 per year (save $65)
6.2 Subscription Content Access
Subscribers receive immediate access to all content on the Platform. Unlike individual course purchases (see Section 7), subscription content is not subject to stage-based dripping. You can access any content at any time throughout your subscription period.
6.3 Free Trial
We may offer a free trial period for new subscribers. During the free trial, you will have full access to subscriber content. To start a free trial, you must provide a valid payment method, but you will not be charged until the free trial ends.
We will send you a reminder email before your free trial ends. If you do not cancel before the end of the free trial period, your subscription will automatically convert to a paid subscription and your payment method will be charged.
6.4 Automatic Renewal
IMPORTANT - PLEASE READ: Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. We will charge your payment method on file for the applicable subscription fee.
For annual subscriptions, we will send you a reminder email at least 7 days before your subscription renews, giving you the opportunity to cancel if you no longer wish to continue.
For Apple App Store subscriptions: Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
For Google Play Store subscriptions: Payment will be charged to your Google Play account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your Google Play account settings.
6.5 How to Cancel Your Subscription
You can cancel your subscription at any time through:
- Your account settings on our website or app
- The Apple App Store settings (for iOS in-app subscriptions)
- The Google Play Store settings (for Android in-app subscriptions)
- Contacting us at [email protected]
When you cancel, your subscription will remain active until the end of your current billing period. You will continue to have access to subscriber content until that date. After that, your access will revert to free content only.
We aim to make cancellation as easy as signing up. If you experience any difficulty cancelling, please contact us and we will assist you promptly.
6.6 Subscription Changes
You can upgrade from monthly to annual billing at any time. Any remaining credit from your monthly subscription will be applied to your annual subscription. You can also downgrade from annual to monthly at the end of your annual billing period.
6.7 Promotional Offers and Free Access Periods
From time to time we may offer promotional pricing, extended free-access periods (such as our founding members offer of 12 months free access), or other benefits. The specific terms of any promotion will be made clear at the time of the offer. Unless stated otherwise, promotional benefits are not transferable, cannot be combined with other offers, and may be varied or withdrawn for future participants at our discretion.
7. Individual Course Purchases
7.1 Available Courses
Users can purchase specific courses without subscription commitment. Current courses and pricing are displayed on our Platform at herjourney.com.au. Course offerings and pricing are subject to change.
7.2 Course Ownership
When you purchase an individual course, you receive permanent access to that course content. Your access does not expire and is not dependent on maintaining a subscription.
7.3 Stage-Based Content for Course Purchases
Note: This section applies only to individual course purchases, not to subscriptions. Some course content may be released progressively based on your pregnancy or journey stage. This is designed to provide you with relevant information at the right time. You will receive full access to all content within a purchased course as you progress through your journey. The content will unlock automatically based on your due date or journey stage as recorded in your account.
If your circumstances change (for example, pregnancy loss or change in due date), you can contact us at [email protected] to request immediate access to all purchased content or to update your journey information.
7.4 Course Updates
We may update course content from time to time to reflect current clinical evidence. You will receive these updates at no additional cost.
8. Digital Content Acknowledgment
8.1 Immediate Access and Your Refund Rights
IMPORTANT: Our digital content (including subscriptions and individual courses) is available for immediate access upon purchase or commencement of a free trial. Australian law does not provide a general cooling-off or change-of-mind period for digital content of this kind; however, your rights under the consumer guarantees (Section 9) always apply.
By making a purchase or starting a free trial, you:
- Acknowledge that digital content will be made available to you immediately
- Consent to the immediate supply of the digital content
- Acknowledge that you will not be entitled to a cooling-off period or change-of-mind refund once you access the digital content
This acknowledgment does not affect your rights under the Australian Consumer Law if the digital content is faulty or not as described (see Section 9).
9. Refunds and Consumer Guarantees
9.1 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
Under the Australian Consumer Law, you have certain rights that cannot be excluded by contract, including the right to a remedy if services are not provided with due care and skill or are not fit for purpose.
9.2 Consumer Guarantees for Digital Content
Our digital content comes with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to:
- Cancel your subscription and receive a refund for the unused portion if there is a major failure
- Compensation for its reduced value if there is a minor failure
- Have problems rectified in a reasonable time
9.3 Subscription Refunds
If you cancel your subscription during any free trial period, you will not be charged. If you cancel after being charged, you will retain access until the end of your current billing period but will not receive a pro-rata refund for that period.
However, if you believe our services do not meet the consumer guarantees under Australian Consumer Law (for example, if the Platform has a major fault or is substantially different from what was described), you may be entitled to a refund. Please contact us at [email protected] to discuss.
9.4 Course Purchase Refunds
As outlined in Section 8, we generally do not offer change-of-mind refunds for course purchases once you have accessed the content. However, we will provide a refund if:
- The content has a major fault or is substantially different from what was described
- You have been charged incorrectly
- Technical issues prevent you from accessing the content and we cannot resolve them
- You are otherwise entitled to a refund under Australian Consumer Law
9.5 How to Request a Refund
To request a refund, please contact us at [email protected] with your order details and the reason for your request. We will respond within 7 business days and process approved refunds within 14 business days.
If you purchased through the Apple App Store or Google Play, refunds and cancellations for those purchases are handled by Apple or Google under their terms, so please request them through the relevant store. This does not affect your rights under the Australian Consumer Law.
10. Intellectual Property
10.1 Our Content
All content and trade marks on our Platform, including but not limited to text, graphics, logos, images, videos, courses, and software, are owned by Eileen Summer Holdings Pty Ltd (ABN 53 696 506 519) and licensed to Her Journey Pty Ltd, or are owned by our licensors, and are protected by Australian and international copyright, trade mark, and other intellectual property laws.
10.2 Limited Licence
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Platform and content for your personal, non-commercial use only.
10.3 Restrictions
You may not:
- Copy, reproduce, distribute, or publicly display our content without our written permission
- Modify, adapt, or create derivative works from our content
- Use our content for any commercial purpose
- Remove any copyright, trade mark, or other proprietary notices
- Share your account access or downloaded content with others
- Use automated tools to scrape, download, or copy our content
10.4 User-Generated Content
If we introduce features allowing you to submit content (such as reviews, comments, or community posts), you grant Her Journey a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify, and display such content in connection with the Platform. You represent that you have the right to submit such content and that it does not infringe any third-party rights. We reserve the right to remove any user-generated content at our discretion.
11. Acceptable Use
11.1 General Conduct
When using our Platform, you agree not to:
- Violate any applicable laws or regulations
- Infringe the rights of others, including intellectual property rights
- Transmit any viruses, malware, or other harmful code
- Attempt to gain unauthorised access to our systems or other users' accounts
- Interfere with or disrupt the Platform or its servers
- Use the Platform for any fraudulent or deceptive purpose
- Harass, abuse, or harm other users
11.2 Account Suspension
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. We will provide you with notice and an opportunity to respond before taking such action, except where immediate action is necessary to protect the Platform or other users.
12. Practitioner Directory
12.1 Information Purposes Only
Our practitioner directory is provided for informational purposes to help you find women’s and maternal health practitioners in your area. It contains factual, publicly available professional information only. We do not endorse, recommend, or guarantee any practitioner, we do not rank or present listings using comparative or promotional framing, and the directory does not include reviews, ratings, or testimonials about any practitioner's clinical care.
12.2 Your Responsibility
You are responsible for verifying any practitioner's qualifications, registration status, and suitability for your needs. We recommend checking practitioner registration status through AHPRA (Australian Health Practitioner Regulation Agency) where applicable. Practitioner information in our directory may not be current, and registration status can change at any time.
12.3 No Agency Relationship
We are not a party to any arrangement between you and any practitioner listed in our directory. Any services you receive from a practitioner are subject to separate terms between you and that practitioner. Her Journey accepts no liability for the acts or omissions of any practitioner listed in the directory.
13. Limitation of Liability
13.1 Consumer Guarantees
If you are a consumer under the Australian Consumer Law, our goods and services come with guarantees that cannot be excluded. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. For minor failures, you are entitled to have problems with the service rectified in a reasonable time.
13.2 Limitation
Subject to the consumer guarantees described above, and to the maximum extent permitted by law:
- Our total liability to you for any claim arising from or related to these Terms or your use of the Platform is limited to the amount you paid to us in the 12 months prior to the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill
13.3 Medical Disclaimer
We expressly disclaim any liability for health decisions you make based on information on our Platform. Our content is educational only and is not a substitute for professional medical advice. We are not responsible for any adverse outcomes arising from your reliance on our content or any failure to seek appropriate medical care.
14. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Her Journey, its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or your use of the Platform.
This indemnification does not apply to the extent that a claim arises from our negligence, breach of these Terms, or breach of our obligations under Australian Consumer Law.
15. Third-Party Services and Links
Our Platform may contain links to third-party websites or integrate with third-party services (such as Stripe for payment processing, Apple App Store, and Google Play Store). We are not responsible for the content, privacy practices, or terms of any third-party websites or services. Your use of such websites or services is at your own risk and subject to their terms and conditions.
16. Dispute Resolution
16.1 Contact Us First
If you have a complaint or dispute about our services, please contact us first at [email protected]. We will work with you in good faith to resolve the issue. Most disputes can be resolved quickly through direct communication.
16.2 Mediation
If we cannot resolve a dispute through direct communication within 30 days, either party may refer the dispute to mediation. The mediation will be conducted in accordance with the Resolution Institute Mediation Rules, and will take place in Victoria, Australia.
16.3 Legal Proceedings
Nothing in this section prevents either party from seeking urgent injunctive relief or from making a complaint to a relevant regulatory authority, such as the ACCC or OAIC.
17. Governing Law
These Terms are governed by the laws of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts that may hear appeals from those courts.
18. Termination
18.1 Termination by You
You may close your account at any time by contacting us at [email protected] or through your account settings. If you have an active subscription, you should cancel it before closing your account to avoid further charges.
18.2 Termination by Us
We may terminate or suspend your account if you breach these Terms, subject to providing you with reasonable notice and an opportunity to remedy the breach (unless immediate action is necessary to protect the Platform or comply with law).
18.3 Effect of Termination
Upon termination, your right to access the Platform will cease. The following Sections shall survive termination: 3.2 (Educational Content Only), 3.4 (Clinician Content Disclaimer), 8 (Digital Content Acknowledgment), 9 (Refunds and Consumer Guarantees), 10 (Intellectual Property), 12 (Practitioner Directory), 13 (Limitation of Liability), 14 (Indemnification), 16 (Dispute Resolution), and 17 (Governing Law).
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and us regarding your use of the Platform.
19.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
19.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
19.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to another entity, for example in connection with a sale of the business.
19.5 Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or internet or telecommunications failures. If a force majeure event causes the Platform to be unavailable for more than 14 consecutive days, your subscription period will be extended by an equivalent number of days at no additional cost.
19.6 Platform Availability
We aim to maintain Platform availability but do not guarantee uninterrupted access. Scheduled maintenance will be notified in advance where possible. We are not liable for temporary unavailability of the Platform due to maintenance or technical issues.
19.7 Unfair Contract Terms
We have drafted these Terms to be fair and reasonable. If any term in these Terms is found to be unfair under the Australian Consumer Law, that term will not apply.
